Terms and Conditions

Clients will be deemed to have read the Declaration on the booking form and agreed to the following four conditions:

a) They have read and accepted our Terms&Conditions and general information pages contained on our website.
b) They appreciate, on behalf of all the people included in their booking, the risks involved in adventure travel.
c) They or anyone else on their booking does not suffer (or has ever suffered) from any pre-existing medical condition which may prevent them from actively participating in the tour.
d) The person signing, or being deemed to sign, the attached booking form (which incorporates these terms) warrants that he/she has full authority to do so on behalf of all persons whose names appear thereon, and confirms that all such persons are fully aware of and accept these conditions

1. Insurance

Travel Insurance is mandatory for all clients. Clients are wholly responsible for arranging their own insurance with adequate protection for the full duration of the holiday in respect of at least medical expenses, injury, death, repatriation, cancellation and curtailment, baggage and
money loss and liability cover. Clients should ensure that there are no exclusion clauses limiting protection for the type of activities included in their time.

2. Your Responsibilities

(i) It is your responsibility to check all current document and health requirements and to obtain all documents required for your holiday, including passports, driving licences and documents relating to health requirements, to ensure that these are in proper order and to take them with you. EKO will not be liable if you fail to do so and you will be responsible for meeting any additional costs incurred by reason of such failure.
(ii) You are responsible for checking-in for flights and trains at the correct time and for presenting yourself to take up all pre-booked components of your holiday. EKO Club can not accept responsibility and no credit or refunds will be given for any failure on your part to take up any component of your holiday. No credit refunds will be given for lost, mislaid or destroyed travel documents.
(iii) Any Information or advise, given by the company regarding, vaccination, climate, clothing, is purely advisory, provided as a courtesy to the Client and the company is not responsible for any errors or omissions as the information provided. Personal property is always your own responsibility

3. Participation

Clients agree to accept the authority and decisions of the company’s employees and leaders. If in the opinion of such persons the health, level of fitness or conduct of a client at any time before or after departure appears likely to endanger the safe, comfortable or happy progress of a  seminar, the client may be excluded from all or part of it without refund or recompense. In the case of ill health the company may make such arrangements as it sees fit and recover the costs thereof from the client. If a client commits an illegal act the client may be excluded from the seminar and the Company shall cease to have responsibility to/for them. If you are affected by a condition, medical or otherwise, that might affect you or affect other people’s enjoyment or active participation, you must tell us in advance No refund will be given for any unused services.

4. Complaints

If the client has a complaint about any of the arrangements, the client must tell us at the time. In the unlikely event, you have any problem or complaint during your trip bring it to the attention of the leader immediately, they have the opportunity to put things right

5. Surcharges

Variations in transportation costs, including the cost of fuel, dues and taxes, and exchange rates applied to the particular package. If the increased costs result in a total amount of less than 2% of your cost, we will absorb these increases. Only if the increased costs exceed 2% we will apply a surcharge to the cost of your stay. If the increase is more than 10% of the price, you will be advised not to do this trip.


6. Force Majeure

Force majeure means any unusual and unforeseeable circumstance beyond our control, the consequences of which neither we nor our suppliers could avoid. Such events may include war or threat of war, riots, civil strife, terrorist activity, industrial disputes, natural or nuclear disaster, fire, adverse weather conditions, level of water in rivers, or other similar events beyond our control. In this case you will be advised not to do this trip.

7. Our responsibility

The Clients should know that  they appreciate the possible risks inherent in adventure travel and that they undertake the seminars at their own volition. It is important, however, that clients realise that they are responsible for making themselves aware (through State Department advisories, Government Tourist Offices and other sources of information) of the risks involved, and are responsible for making their decisions accordingly. No refund will be made for any unused services which are included in the price. The Company shall not be liable for any delays of air or train travel, deviations or omissions from any seminars caused by circumstances beyond its reasonable control, nor for any direct or indirect consequences thereto. The Company shall not be liable to compensate clients for associated expenses incurred as a result of their mistake.

8. IMPORTANT: LIABILITY INSURANCE

Limited insurance is held by our Company. The client acknowledges and accepts that there may be no policy covering the Company’s liability to its clients for death, injury, damage or loss. The client also specifically acknowledges that with respect to passenger accident liability cover this cover may be very limited or may not exist at all. The client acknowledges that the company has taken reasonable steps in safeguarding its liability. Although the Company does hold various insurances this booking condition states that the client must assume he/she is not covered by any Company insurance policy, including all liability insurance, for death, injury, damage or any other loss.

9. Legal term

The contract is between the company and the client, being any person travelling or intending to attend our seminars. The contract, including all matters arising from it, is subject to Bulgarian law and the exclusive jurisdiction of the Bulgarian Courts.
